Terms of Service
Effective date: January 1, 2026
These Terms of Service ("Terms") govern your use of realestateghl.com and any products or services purchased from Hi5 Biz Solutions LLC ("Hi5," "we," "us," or "our"), including the Ultimate Real Estate OS and related snapshots, custom builds, and licenses (collectively, the "Products").
1. Not a Real Estate Brokerage; No Professional Advice
Hi5 is a technology and automation product provider. We are not a real estate brokerage, are not a party to any real estate transaction, and do not provide real estate, legal, tax, or financial advice. Nothing in our Products or marketing materials should be construed as such advice.
2. Not Affiliated With GoHighLevel
Our Products are built on the GoHighLevel platform, but Hi5 is an independent company and is not owned by, operated by, or officially affiliated with GoHighLevel. We are not responsible for GoHighLevel's platform uptime, features, pricing changes, or any issues arising from the GoHighLevel platform itself, outside of our own snapshot configuration.
3. Your Responsibilities and Compliance
As a licensed real estate professional (or team/brokerage) using our Products, you are solely responsible for:
- Your own compliance with Fair Housing laws, TCPA (telephone/text consent) requirements, CAN-SPAM, MLS rules, IDX agreements, and any other applicable law or regulation
- The content of your own marketing communications, client interactions, and business practices
- Maintaining your own real estate license and any required professional credentials
- Obtaining and maintaining your own GoHighLevel account and any required agency-level access
Hi5 provides tools and automation; you remain responsible for how you use them.
4. License to Use Our Products
Subject to these Terms and full payment, we grant you a limited, non-exclusive, non-transferable license to use the Products you've purchased for your own business. Specific license terms vary by tier (DIY, Done For You, Custom Setup, Agency License) as described on our Pricing page. Reselling or redistributing our standard snapshot as your own packaged product is prohibited except under a valid Agency License, and even then, subject to the restrictions described on the Agency License page.

6. Intellectual Property
Hi5 retains all intellectual property rights in the Products, including all pipelines, workflows, automations, templates, and content provided "as-is," except for custom work you build on top of it yourself, or custom builds specifically licensed to you under a Custom Setup or Agency License agreement, as described on those respective pages.
7. Disclaimer of Warranties
Our Products are provided "as is" and "as available." We do not warrant that the Products will be uninterrupted, error-free, or meet your specific business needs. If our system has a bug or isn't functioning as designed, we will fix it free of charge — this is a support commitment, not a legal warranty of merchantability or fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, Hi5's total liability to you for any claim arising from your use of our Products will not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.
9. Indemnification
You agree to indemnify and hold Hi5 harmless from any claims, damages, or expenses arising from your use of the Products, your business practices, or your violation of applicable law.
10. Dispute Resolution; Arbitration Agreement; Class Action Waiver
Please read this section carefully — it affects your legal rights.
Any dispute arising out of or relating to these Terms or your use of our Products will be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. You and Hi5 each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative action. Arbitration will be conducted under the rules of a mutually agreed-upon arbitration provider, with proceedings held in or near Fort Bend County, Texas, unless otherwise agreed.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. If we make a material change — including changes to the arbitration provision in Section 10 — we will provide notice by posting an updated effective date on this page and, where practical, by email or another reasonable method. Your continued use of our Products after a material change becomes effective constitutes acceptance of the updated Terms.
